I have tried: modprobe ivtv tuner=38 (and a few other likely tuners)
with the same result. I just get static on channels where there should
be signals.
Is there something else I should be doing to get this to work?

2.6.16 kernels require ivtv 0.6 series. Please try the ivtv 0.6.2
release and see if you get better results.
