Actually I just wanted to know since this came up in Roller blog server project that is under Apache Incubator. Not trying to cause any problems.

In order for Hibernate's statement to be true, we would need to have the FSF state that distribution as a separable jar file is sufficient to be considered a separate, unlinked distribution (section 4) rather than an executable (section 6). Personally, I think it would be easier to just write a better license that is specific to how the developers want their java library distributed, rather than wasting time trying to make a pig smell like a rose.
