It all comes down to what is reasonable, as permiates so much of law
and its interpretation.  Most people would agree that patents on a
particular (taking a random example) kind of multi-touch sensitive
screen technology are reasonable and - probably - foster innovation.
Equally, most of the same people would also agree - I think - that a
patent banning anyone from using any kind multi-touch screen to zoom
in on a picture is unreasonable and cannot be said to foster anything.

So the argument is not about whether or not patents are good or bad
but about when they are useful (to society in general) and when they
aren't. Hence the argument:  Hardware patents good/software patents
bad.
