I've realised that the iPhone/Pad/Pod "market" is not a market, it's a franchise. You follow the rules and your apps are subject to approval (even post release). Apple let you to take a commission on the app you have written for them. You could argue they are simply outsourcing the development of apps for their store. This has its pros and cons and I'm not trying to sound overly negative about it, but that IS the model. Trying to find technical answers to Apple's policy is somewhat redundant in this context.
