So your argument is that, despite the need for android to skirt around patents, that the patent system was still a great boon to Android, because by forcing people into arbitrary and pointless distractions, somehow this forces people into being more innovative.
Fantastic. If this works, lets take it to the next level and, oh, I dunno, outlaw all 'for loops' in code in April. Just imagine the crazy amounts of innovation that's bound to produce! NB: The discussion isn't "are software patents evil". The discussion is: "Do software patents cause more good than harm, and if not, is there any comprehensive reform proposal that stands a chance to pass into legislation that likely will".
