Open-source vs. proprietary does not speak to patented vs. patent-free.
Those are different dimensions you could measure software against (e.g., I
could have open-source software that depends on some patent, or
proprietary -- i.e., closed-source -- software that is patent-free).

However, AFAIK almost all the software at jabber.org and jabbercentral is
labeled as to its licensing (though not necessarily in relation to any
patents).
