Good spot. I can confirm the key here appears to be the Document Mode. In the developer toolbar (F12) with Document Mode set to anything other than Internet Explorer 9 Standards, the page renders wrongly.
IF the Document Mode is set to Internet Explorer 9 Standards, the page renders correctly regardless of the browser mode.
It seems like the Document Mode is the key to rendering correctly in IE9.
