Committe Reports Courts In Lakes State Misinterprating Customary Law In Cases
News from Sudan Radio Service
9 June 2011—(Rumbek) —The Fact Finding Committee formed in Lakes State
parliament has reported that the courts in the state are not acting in
line with the customary law of the area.

The secretary of the committee, Honorable Shadrack Bol Machok said
that in Yirol, the courts have misinterpreted the customary laws.

[Shadrack Bol Machok]: “We have found out that the court is not
working in conformity with the provisions of the customary Act 2010 of
Lakes State. According to lakes sate customary law section 26 says
that if someone attacks a group of people or a person and in the
process of attacking, other people who are innocent he ends up being
killed then by the people whom he intended to kill then his blood was
not to be compensated. This is because he intended to die by trying to
attack other people. But here the law was misinterpreted."

Bol added that fines are being over charged as compared to its initial
provision.

[Shadrack Bol Machok]: “The fine that is their stipulated in the
customary law like for example a fine of five thousand for a person
convicted of murder, that one has been exaggerated by the special
court of number one of Yirol. They instead collect a fine of ten
thousand Sudanese pounds which is not in line with the provision of
the customary law Act 2010 of lakes state. Again the collection of
fines and cows that are being paid as blood compensation to the
parents of the decease is not put as priority.”

The Fact Finding Committee stressed that there is need to put
professional judges to head cases in the courts in Lakes State.
