The way the spammers work there are layers of indirection. The email
account used to send the email was likely on a computer that had been
taken over by hackers, so tracing it back to the actual sender would
only yield a helpless victim (though they're probably running Windows,
so maybe that should be "a willfully helpless victim"). The site itself
also likely has deniability, in that they simply pay third parties for
bringing visitors to their site but would *never* condone doing so by
means of spam, of course.
Unfortunately the SMTP protocol used for email was never designed for
security and authenticity, so until that's replaced we're stuck in a
world of spam. The good news is that there are a couple of efforts in
progress to make changes. The bad news is that the last I heard they
were hampered by patent fights and such, so it's probably going to be
years more before we see any significant change.
