When eBay says it can't tell you the outcome, that doesn't necessarily mean that they will do nothing. I reported someone who violated eBay's rules, and got the same reply. However, a day or so later, I was informed that the auction on which I had bid on had been cancelled. So yes, they DO take action sometimes. I'm afraid that there is a distinction between illegal and unethical, and I'm not sure eBay is quite as concerned about the latter.
