Why knowingly proceed ahead if you know you will be breaking the Law in

I am developer of the Lazarus project, registered since Sun, May 2nd 1999 05:37 PDT
on freshmeat (http://freshmeat.net/projects/lazarus/).
I might be a good idea to support Lazarus development by having a foundation, but
throwing away the name is not a good idea. (see for example
http://www.google.nl/search?q=lazarus+ide , a pity to loose that name recognition )
The Lazarus project does not own properties, so suing it for using the name for more
than 8 years now (also in the USA) doesn't make any sense.
But if you fear this, I see several options:
* Choose a different name for the foundation, (not for the project)
* Don't operate in the US
* Don't create a foundation, if you think that it is only raising money for
trademark registration or legal defense.
