The GEDCOM 5.5 spec says...

 n  [ DEAT | BURI | CREM ] [Y|<NULL>]   {1:1}
    +1 <<EVENT_DETAIL>>  {0:1}

So Legacy is correct. The OP should report this as a bug to the
manufacturer of the other program.
