The way you described your problem in your first message the second data folder was inside the first C:/Legacy/Data/Data. If you delete the first you will also be deleting the second.
You have to use Ron's suggestion to drag all the contents of the C:/Legacy/Data/Data folder into the C:/Legacy/Data folder to leave the C:/Legacy/Data/Data folder empty.
