Legacy works in Windows and Windows is not case sensitive for file names so Legacy will still display the pictures etc.
The difficulty comes if you ever decide to use your file and data outside Windows. Most web servers do not use Windows and they do use operating systems which are case sensitive, web pages could have problems if Legacy outputs the file name without the surname portion in all caps. I am also not sure what impact there would be if you use Families on a portable device when travelling. I have never used Families (do not own a device to use it on) so I do not know if it even tries to transfer photos. Families converts your data to use it on either Android or IOS (Ipad Operating System) and I think both those systems are case sensitive for file names so photo file names would have a problem.
