This is tough because there always is the possibility of patents that are not yet known. I believe source code that violates patents when compiled is legal, and that it is legal for a user to compile such source code as long as the binary is not distributed or used to provide a service. For example, you as an individual can compile and use the LAME libraries but you can not distribute the compiled binary or offer an mp3 encoding service on your web site without properly licensing the patents.
