No, it is your assumption as I would never punish anyone for any crime  by 
murdering him.
So, this must be your ramification  what you would do if  faced with a case of 
a mother who is charged with killing of  her baby in the 9th of pregnancy, if 
the law would prevent it.
Laws do not require violent solutions, but education. At any rate, to most 
decent people it is obvious that killing of a  baby once it ceases to be  a 
fetus [ about 3-4 month max]  should be considered a crime. Besides logic, most 
humans also use conscience when making moral decisions.
