The age of a particular word has nothing to do with whether it has come into
common usage and thus not subject to trademark laws. Anecdotally, I find the
suggestion that libertarian is in common usage laughable. Although perhaps a
majority of the public has heard the word at one time or other the percentage
of those who know what it stands for is likely in single digits. The
percentage of those who use it regularly is smaller still.
There is, sad to say, nothing common about the word. If it were otherwise we
would not be barking around in the galleries waiting for admittance to the
debate floors.
Several years ago the NLP trademarked the name "Libertarian Party." It is
available for use only by NLP affiliates. Mr. Smith may be entitled to claim
he is a representative of the "American Libertarian Party," but only if he
always includes the word "American" and only if the courts deem the distinction
clear enough as to not confuse the public.

You continue down this path and you will be severely embarrassed.
The word Libertarian is a noun, a verb and an adjective in accordance with
its use in a sentence.
The word came into the lexicon back in the 1570s and is a common word not one
of unique ownership.
Continue down this road and you will be very mightily embarrassed as you
should be for being so stupid.
I will use the fact that I am a Libertarian in all of my news releases and
advertisements, and I will use the fact that the LPF is a Republican Party
also.
Lets get it on. I am ready. You are going to be embarrassed beyond your
ability to remain in politics in Florida.
