I don't think that John Wayne Smith even claims that he is running as 
the candidate of the "American" Libertarian Party, let alone as a 
candidate of THE Libertarian Party. As I understand it, he is running 
as an independent. His campaign slogan is: " A Libertarian Candidate 
for Governor." Try as you might, I don't think that you can stop him 
from claiming that he is a libertarian, nor can you stop him from 
claiming that he is a candidate for governor. I would think that the 
best you can hope to do is to use the power of the state to force him 
to change his campaign slogan to: "A l(lower case L)ibertarian 
Candidate for Governor". And how petty and mean-spirited would that 
be?
