It's not, because you would make illegal an activity that might only be limited 
by some contracts. Even in the case where the contract specifies that neither 
party is to commit adultery, it is not a criminal matter if one party intended 
to uphold the terms of the contract but later violated them for whatever 
reason. Then it's a matter of tort in which the other party must prove injury. 
   
  Women are not property and cannot be treated like slaves. You would alienate 
people from their right to freely associate by completely criminalizing an 
activity that is only a contract violation in some cases.
