Vic, UNIVERSAL ibertarianism, and most of the common law of the land 
for that matter, presumes that a 'person' is COMPETENT enough to be 
responsible for unwarrented harm they do to others, unless proven 
otherwise.  

Of course, as always, 'utopia' is NOT an option, but improvement can 
certainly be one   :)
