The second half of section 3 is quite likely not compatible with the GPL, as it imposes a further restriction upon redistribution that is not present in the GPL itself. [From my reading, it conflicts directly with the language of section 7 of the GPL.] I'm not aware if compatibility with the GPL is a necesary quality for the ASL to have, but if it is, it seemingly does not have it. Perhaps Eben Moglen [Cc:'d in case he is not subscribed] would be willing to make a more in depth commentary upon this?
