Sorry about the delay in replying but I've been so overjoyed to get diald
working (just got to get the filters working how I want them to:-) ).  Mark
came up with a solution that is working for me which is included below.
Hope this helps all people who have and do experience the same problem.

>From previous discussions on the list, this is caused by diald
accidentally closing the file descriptor for the modem before exec'ing
chat.  The fix would be to add "fifo /etc/diald/diald.ctl" to your
diald.conf so that diald has one more file open.  You might also have to
add "tcpport <some port #>" if you still get the error, but I don't have
to do that here.
