I'm sorry - but this is utter bullshit. 

First, a particular implementation cannot be patented. It might be 
considered "practicing the patent" and require licensing.

More important however, is that a patent is *designed* to allow 
publication of full information while still ensuring the patent owner 
gets his due - this is why patents were invented, so inventors would 
feel safe in publishing their invention for the benefit of everyone and 
still get paid!

If your client has a patent on something which the program implements he 
can release the source code under the GPL without a worry because a 
patent license is still required to "practice the patent" - run the 
program even without any consideration of copyright issues.

You client should REALLY get a good lawyer.
