This depends on the kernel version. The 2.2 kernels will complain that
/dev/cua* is depreciated and you should use /dev/ttyS*

The first question I would like to ask about this is what is /dev/modem
linked to?

Are you sure that your modem is at /dev/ttyS1 and not at /dev/ttyS0?
