Without seeing the exact errors, I can't say if you have "other problems".
It is certainly possible that your phone line, or the modem at the other
end, isn't up to the higher speed ... but then, if the serial conection to
the new modem is 38400, the modem should be dropping back to 33.3 in any case.

The 16450 UART is definitely a problem. Based on my experience, it is
unreliable at speeds over 19200. Do upgrade to a 16550A or better; at least
here in the US, the boards for this upgrade are pretty cheap (US$30 last
time I checked).
