things are working now...solution/workaround is below suse was using 2.6.8 in 9.2...however I could not find patches/modules for that one to run on 1950 (needed bnx2, and megaraid_sas for those interested)...I should add that the 9.2 that I was saying worked was not on a 1950...was just looking for some clues...
