yes if they demanded license fees when they weren't entitled to them and knew they weren't entitled to them they would probably contravene the fari trading act.
i ask again: have they done this IN NZ?
I'd love them to make such a claim, i'd say "sue me and prove your case"
Shot one : "further particulars of your claim are required to fully and fairly inform the defendant of your cause of action. In particular:
(a) which lines of source code are relied on as infringing?
(b) on what dates and by whom were those lines written? by whom, and were those persons employees or contractors of SCO?
(c) on what date did SCO become entitled to the intellectual property in such lines of code
yada yada."
I do not like or approve of SCO's actions, and these cross-border
distinctions are very nebulous these days with the net etc. FUD in the
US causes the same uncertainty and doubt in NZ, but probably doesn't
break any NZ laws.
If someone wants me to get an opinion form some hotshot IT lawyer, put your money up and I'll get a opinion. It will cost money though :-)
In the meantime, I think that the more SCO is ignored, the more likely they are to go away.

You're the lawyer, what laws HAVE they broken? I am sure we can find some ;) What have the boys in Australia done? Maybe we can review their position and use some of their wording/ideas? I am sure there is something in NZ law that prevents this sort of thing - at least I'd hope so. After all, it aint as bad as the states here - yet.

yes but how do you say thay have broken the laws of NZ?
I think they need to do that before you make a complaint to the Commerce Commission :-)

Consider it a pre-emptive strike, like they have done. Through their statements they have threatened EVERY Linux user in the world, including you and me.

Has anyone in NZ actually been asked for any money by SCO?
Have they actually DONE anything in NZ in relation to this silly litigation?
The commerce comission is not going to investigate something outside its jurisdiction :-)

Hi Nick,
Being our resident lawyer, could you spearhead something like this in NZ??
