My latest reply to the Commerce Commission....... Thank you Sarah for your reply but you still have not explained how Telecom is not breaching the act when it seems apparent to everyone I speak to that they are.
The issue is that Telecom seem to impose barriers to UBS customers which they are not imposing on Xtra customers. Are you confusing my complaint with other complaints of delays? I can accept that there are delays but I do not accept that the delays should be consecutive, they should be concurrent - that is my complaint. How can it be fair that a connection cannot be arranged before a disconnection is done? This limitation is not imposed on Xtra customers. To spell it out: If there is a 9 day delay for a disconnection and a 9 day delay for a connection the total delay should be 9 days - not 18. Both orders should be able to be placed at the same time. Please respond with reasons for your decision or forward my complaint to someone who can give it due consideration. I apologise for the terse manner of this email but I am left rather frustrated with the Commissions reponses to date. Section 41, paragraph (a), subparagraph (ii)of the The Commerce Act 1986: (a) The supply of goods shall be deemed to be prevented if--- (i) The supply of those goods is refused except on terms that are disadvantageous to the person acquiring the goods; or (ii) The supply of those goods is on terms which are less favourable, whether in respect of time, method, or place of delivery, or otherwise, than the person who supplies the goods treats other persons to whom the same or similar goods are supplied:
