Do you know what driver is controlling your touchscreen? There are 2 or 3 different wacom touchscreen drivers in kernel and 1 built directly into xf86-input-wacom for ISDV4 serial touchscreens.
The main driver I'm familiar with is the kernel driver "wacom" because it is very similar to my Bamboo tablet driver. In this touchscreen driver and the very lastest Linux kernel's, it gives priority to pen&eraser over touch because of issue your talking about. I believe the older versions did not. Also, recently some logic was added to xf86-input-wacom for case of a 2nd Linux kernel touchscreen driver and give priority to pen&eraser.
