It MIGHT cause all sorts of effects. Some of them MIGHT be
constructive. Some MIGHT be devastating.
Hypothesizing about consequences is, perhaps, an enjoyable source of
distraction, but it is an utterly empty exercise, absent data which moves
the conjecture from might to does.
In the absence of substantiating data, therefore, your conjectures do not
in any way alter the fact that NSI has placed itself in a position of
giving additional rights to trademark holders, beyond that granted by the
courts.

ps. Since you acknowledge that you substantiating your guesses would be
difficult, one MIGHT try to guess why you are offering such 'might's,
rather than attend to the objective facts of NSI's policy.
