  This is normally true.  but under certain circumstances and at any
judges allowance such discovery could be ordered should that judge believe
or be persuaded to believe that it is relevant and in his/her(judge) opinion
necessary for proper adjudication of the appeal...  Therefore such a
motion could be submitted depending on the terms of the appeal
as well....
