Not the least of which is the admission that NSI controls the market and is 
acting as a private party -- since they admit they get no meaningful 
oversight --  rather than simply as an agent of the US government.

The anti-trust component was dismissed because Bode lacked standing as 
a  competitor, rather than because the complaint lacked merit.

But that probably isn't what Tony wanted to focus on, in the decision.
