The root is an open issue, but I suspect that ICANN will have a very
difficult time getting NSI to give up com/net/org, and should they just
ignore NSI and start to run it themselves, I also suspect that the legal
battle would dwarf anything even imagined to date. Quite honestly, I
don't know where ICANN would get the money needed to fight such
a battle.
But then, I'm not a lawyer and am just guessing.
