I vary, depending on the site content.
First up, 'article' content (or whatever you want to call to main
content of a page) always gets an <h1>. But I'll also give <h1> to
other top-level parts of the site. In this case, I often find that the
Site Title is an appropriate heading for the main, global navigation
of the site.
Ending up with something like this:

<h1>An article about something or something</h1>
<*>…</*>
<h1>MySite.com</h1>
<ul class="nav">
<li>Home</li>
<li>Blog</li>
<li>Portfolio</li>
<li>About</li>
</ul>
</body>
Of course, that might not be appropriate for every site. If it wasn't
appropriate to use an H1 like in the above, I'd make it a <div>, with
a subtitle as a <p>. I wouldn't use a <dl>.
