I suppose that would depend a lot on the circumstances,
wouldn't it.

There would likely be a penalty probably similar to the
very large penalties for using your LetraSan in a no discharge
zone.

I would never use emergency measures unless there was an
emergency and then I might consider the trade of my life
for a pointy headed bureaucrats hectoring me, worth
the trade.  I am a lawyer and know how to win in our court
system with the truth.
