I believe, just because something has been broadcast does not make it in the
public domain.

http://en.wikipedia.org/wiki/Public_domain

Definition

The definition of public domain is not uniform and may not only include
completed works, but also permitted uses of works still covered by intellectual
property rights, such as for example the right to excerpt short quotations in a
review. This definition divides areas of private property from areas of the
public domain. For example, Mozart's plot is public property, and Britney
Spears's music is private property.[1]
[edit]

...

Music is in the public domain if like with any other work in the public domain:

    * all rights have expired or
    * the authors have explicitly put a work into the public domain
    * there never were copyrights <<---* Unless this is your argument?

How exactly does re-broadcasting information already in the public domain
become theft?

Well Kyle you have a unique definition of theft that I have never come
across before in my 50 years on this planet.

If I hack into amazons servers and download the credit card details of
all their customers, the law would say I have stolen that data. I dont
have to remove them, I still have stolen them and I would be charged
with the theft of that data. If you break into someones offices and
take copies of their private information from their filing cabinets,
that is theft.

it is not archiving, cloning, or any other of the words that have been
used here, it is theft.

You are the only person on this list arguing that taking something
that does not belong to you without the permission of the owner is not
theft. The argument of the rest of this list is that it is acceptable
practice as they are being robbed by other people as well.
