Not quite. They have not categorically say that it is "closed source".
That would be in violation of the GPL.
They claim that they are simply DELAYING release of the code till the
next version. Unfortunately the GPL doesn't specify a hard deadline
when source code should be released, and that is a loophole the "Don't
be Evil" guys are exploiting.
But as Tim has pointed out multiple times, there are third party
vendors such as ASUS and the like who have played by the rules and
released the honeycomb kernel code to the public.
