Android is release under the Apache 2.0 software license, so legally speaking 
it is Open Source Software.

Practically speaking you can go and do this:

mkdir android ; cd android ; repo init -u 
git://android.git.kernel.org/platform/manifest.git ; repo sync ; make


and you have a your own compiled android on your linux box.  Google not being 
very transparent in the way it releases its code to the community doesn't make 
it closed source.
