Have you tried /usr/... instead of $HOME/.local/... ?
Actually search path according to XDG specifications is $XDG_DATA_DIRS
then $XDG_DATA_HOME so if file under $XDG_DATA_HOME works then it should
work under $XDG_DATA_DIRS as well.

Although I believe this issue should be filed as a bug instead of making
such workaround for it, the 'Empty Trash' menu item is present everywhere
where Trash Can is showed but desktop.
