Whilst IE clearly abused User-Agent in this way in the past, the current result is an unwritten change to the specification in which the comment is no longer a comment and is a key part of the User Agent. Sites that do User Agent sniffing explicitly detect IE from the comment field rather than simply saying it's Mozilla, so it must be Netscape 2 compatible. Simply faking the Mozilla part does not make the User Agent match current big 2 browsers as far as browser sniffing is concerned.
