Hi, This update shouldn't be an issue. Where those sorts of issues happen are when you've updated your phone to a newer version than your newer purchased phone has installed. So, if you update today to iOS 10, your new iPhone should also have that same iOS installed. If you waited a couple of months and iOS 10.1 had been released, but the phones sitting in boxes in the store have yet to receive the update, then you could have the issue.
