According to the article, echoed in the mac accessibility mailing, Samsung has lost this battle in the German court in question. However the pr damage should haunt them seriously. Does not google use their phones for their accessibility items? If the company wants to fight access, it should lose the right to such contracts etc.
Just based on a swift read, voiceover is not going anywhere.

it violated one of their patents. What is disturbing, they are trying to get 
devices with Voice Over banned. Knowing what this would do to the blind

business move. This could actually affect how the blind community has access to
