Made similar observations with US companies which clearly used data
either harvested from websites or even worse, obtained from data
breaches and then argued 'but we offered the legally required opt-out
option so this is not spam'.

In Switzerland, validated opt-in is a requirement - in fact a sender
has to provide proof on how exactly the recipient opted-in to receive
advertisement emails - this can be via validate opt-in or can happen if
he purchased goods or services from the sender therefore becoming a
'customer' of the sender.
