Abernathy, a Republican, spent four and a half years at the FCC. The departure leaves the FCC with four commissioners, only if and when Republican nominee Deborah Tate wins Senate confirmation. At the moment, the FCC is split between two Republicans (Abernathy and Chairman Kevin Martin) and two Democrats (Jonathan Adelstein and Michael Copps). One seat is vacant.
