In many countries, when prosecutors indict on charges, statute defines the charge with a "punishable by" clause. This is a variant of that common feature of the law in many countries. The court trial, not the NKVD, determined innocence, guilty as charged, or guilty of lesser charges. That these lists (wildly called shooting lists) went by Stalin or Molotov or some top official had no effect on the judicial process.
