I'm pretty sure the answer is that the concept of "top application" outright does not exist. There is only one application visible at a time in the design, and the window manager decides which app that is. Some application deciding to want to override that with a "top" hint... not very nice at all.
if MeeGo does not ignore this hint, that'd be a bug... we should just outright ignore it.
