Isn't this the exact reason that you should always replace tires in a set of 4 
on an AWD vehicle? I would suspect that the rear tires are larger diameter.

Yep. The allowable limit in tread depth between tires is usually around 3/32" before the AWD freaks out thinking there is slip because the wheels are turning at different speeds, and/or you damage the transfer case.

An acquaintance ruined the transfer case in a Murano this way. The tire shop should know better.
