I figured there was a bit more to the planning commission story.

Dogs wandering around is heavily frowned upon in california. Almost everywhere,
if you call animal control after you capture an animal, they'll bang on the 
owner's door, give them the animal back, plus a citation, and often, a notice
to appear if the fence is deemed inadequate.

In one county that I spend a lot of time in, they actually post signs along
the highway warning owners that dogs caught off their property can be
destroyed.
