Oh...sorry about shale translation. As I saw in the spanish-english dictionary for 
"shale";  in spanish: "esquisto" or "aceite (oil) esquistoso" that I thaught ii was  
some material like oil. 

A de-sanding or 'de- shaling' basin will be good, as Frank said. Length depends on 
particle size and weight. At least, may be  6 - 8 meters.

    If shale is similar to oil and floats over the water, the solution would
  be a concrete or steel tank with enough area for low velocity in the
  outgoing stream, up waters from the forebay, with a separation plate for
  catching the floating shale and take it away by means of a syphon or some
  other device.
    This idea together others could help you in find the best problem solving.

        My stream has large amounts of shale that comes out of the mountain.

           With an overshot wheel, shale would not be an issue. I am not sure
