(2) Whoever, as an owner or employee of an enterprise indicated in subsection (1) and without authorization: 1. opens a piece of mail
Where authorization does not neccessarily mean an explicit one by the author or recipient - it is implied whereever such an action is required for operational purposes.
Obviously, ISPs may be sued for damages if mail virus scanners discard important mail (and even viruses could be important e.g. for a security consultant), but going by the snail mail analogies, it is extremely unlikely that operating such a scanner would be viewed as criminal by any German court.
